Green Residential Building Program
The Green Residential Building Program (GRBP) will promote green design and building practices throughout New York State by offering incentives to Owners of newly constructed or substantially renovated green residential buildings of fewer than 12 units. A green residential building incorporates design and construction practices that can lower energy costs and production of greenhouse gases, reduce waste and water use, and improve indoor air quality.

Regulations
Final Regulations were adopted by NYSERDA’s Board of Directors on March 1, 2010. The 45-day public comment on the proposed regulations concluded on February 8. Five comments were received during the comment period. NYSERDA has prepared the Response to Comments document.
Background Information
In September 2008, Section 1872 of the Public Authorities Law (PAL) was enacted, authorizing NYSERDA to establish and administer a Green Residential Building Program. The GRBP is to provide incentives to Owners of new and substantially renovated green residential buildings that receive a Certificate of Occupancy or Certificate of Completion on or after January 1, 2010. The GRBP applies only to residential buildings with fewer than twelve dwelling units.
PAL Section 1872 requires NYSERDA to develop rules and regulations establishing green building criteria and the amount of incentives that will be paid. NYSERDA convened an Advisory Group to help guide this effort. The Advisory Group met initially in January 2009, to review and comment on the Green Residential Building Program Briefing Paper and identify issues to clarify in the early stages of rule development. The Advisory Group met again on June 19, 2009, to review and comment on the draft proposed regulations.
